1. PARTIES

1.1. SELLER: This website is operated by la nappe home. Throughout the site, the terms “we”, “us” and “our” refer to la nappe. la nappe home offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

1.2. BUYER: The individual who places an order via lanappehome.com and accepts this agreement.

2. SUBJECT

The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of the product, the qualities and sales price of which are specified in the order placed by the BUYER electronically via the SELLER’s website, in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

3. ORDER AND PAYMENT

The type, quantity, sales price, and payment method of the products are as stated at the end of the order process and have been approved by the BUYER.

4. DELIVERY AND PERFORMANCE
  • 4.1. Processing Time: “Ready to Ship” items are dispatched within 1–3 business days. “Made-to-order” (custom-made) items require a production period of 15-20 business days.
  • 4.2. International Shipping & Customs: For some international orders, customs duties, taxes, or import fees may incurred in the destination country. For a detailed information on which fees are the sole responsibility of the BUYER or SELLER, please check the Shipping & Delivery Page.
  • 4.3. Damage During Transit: The BUYER must inspect the package upon delivery. If there is visible damage, a report must be filed with the courier company before accepting the parcel.
5. RIGHT OF WITHDRAWAL AND RETURNS
  • 5.1. Standard Products: The BUYER has the right to withdraw from this contract within 14 (fourteen) days without giving any reason for standard “Ready to Ship” items, provided they are unused and in original packaging.
  • 5.2. Custom & Made-to-Order Items (Exclusion): In accordance with consumer protection laws, the Right of Withdrawal does not apply to goods prepared in line with the consumer’s specific requests or personal needs. Since la nappe provides custom-made linens and tailored products, these items are non-refundable and non-exchangeable unless they are defective or arrive damaged.
  • 5.3. Return Shipping: Return shipping costs for standard items are the responsibility of the BUYER unless otherwise agreed.
6. INTELLECTUAL PROPERTY

All designs, images, and content on lanappehome.com are the intellectual property of la nappe. Unauthorized use is prohibited.

7. GOVERNING LAW AND JURISDICTION

This agreement is governed by the laws of the Republic of Türkiye. In case of disputes, the Consumer Arbitration Committees and the Consumer Courts in the SELLER’s place of residence shall have jurisdiction.

8. CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page.
We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

LA NAPPE HOME MESAFELİ SATIŞ SÖZLEŞMESİ

1. SÖZLEŞMENİN TARAFLARI

İşbu Mesafeli Satış Sözleşmesi (“Sözleşme”), aşağıda bilgileri yer alan Satıcı ile lanappehome.com (“Web Sitesi”) üzerinden ürün satın alan Alıcı arasında, Alıcı’nın siparişi onayladığı tarihte elektronik ortamda akdedilmiştir.

ALICI BİLGİLERİ Web Sitesi üzerinden alışveriş yapan, fatura ve teslimat adresi ödeme sayfasında belirtilen kişidir.

2. SÖZLEŞMENİN KONUSU VE KAPSAMI

Bu Sözleşme, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği çerçevesinde, Alıcı’nın Satıcı’ya ait Web Sitesi üzerinden elektronik ortamda siparişini verdiği ürünlerin satışı ve teslimi ile ilgili tarafların hak ve yükümlülüklerini düzenler.

3. ÜRÜN BİLGİLERİ VE FİYAT

Sipariş edilen ürünlerin cinsi, miktarı, marka/modeli, rengi ve tüm vergiler dahil satış bedeli, Alıcı’nın ödeme sayfasındaki seçimleri ve sipariş onay e-postasındaki gibidir. Kargo ücreti, aksi belirtilmedikçe Alıcı tarafından karşılanır.

4. GENEL HÜKÜMLER
  • 4.1. Alıcı, Web Sitesi’nde sözleşme konusu ürünün temel nitelikleri, satış fiyatı, ödeme şekli ve teslimata ilişkin ön bilgilendirmeyi okuyup teyit ettiğini beyan eder.
  • 4.2. Sözleşme konusu ürün, yasal 30 günlük süreyi aşmamak kaydıyla Alıcı’nın yerleşim yerinin uzaklığına bağlı olarak Web Sitesi’nde belirtilen süre içinde teslim edilir.
  • 4.3. Satıcı, sipariş konusu ürün veya hizmetin yerine getirilmesinin imkansızlaşması halinde, bu durumu öğrendiği tarihten itibaren 3 gün içinde Alıcı’ya yazılı olarak bildirir ve varsa teslimat masrafları da dâhil olmak üzere tahsil edilen tüm ödemeleri en geç 14 gün içinde iade eder.
5. CAYMA HAKKI

Alıcı; mal satışına ilişkin mesafeli sözleşmelerde, ürünün kendisine veya gösterdiği adresteki kişiye teslim tarihinden itibaren 14 (on dört) gün içerisinde, hiçbir hukuki ve cezai sorumluluk üstlenmeksizin ve hiçbir gerekçe göstermeksizin malı reddederek sözleşmeden cayma hakkına sahiptir.

  • Cayma hakkının kullanılması için bu süre içinde Satıcı’ya yazılı bildirimde bulunulması ve ürünün 6. madde hükümleri çerçevesinde kullanılmamış olması şarttır.

6. CAYMA HAKKI KULLANILAMAYACAK ÜRÜNLER

Alıcı’nın istekleri veya kişisel ihtiyaçları doğrultusunda hazırlanan ürünlerde (örneğin; özel ölçü dikilmiş masa örtüleri, kişiye özel nakışlı peçeteler vb.) cayma hakkı kullanılamaz. Hijyen açısından iadesi uygun olmayan ürünlerin ambalajı açıldıktan sonra iadesi kabul edilmez.

7. UYUŞMAZLIKLARIN ÇÖZÜMÜ

İşbu Sözleşme’den doğan uyuşmazlıklarda, Gümrük ve Ticaret Bakanlığı’nca ilan edilen değere kadar İl veya İlçe Tüketici Hakem Heyetleri, bu değeri aşan durumlarda ise Tüketici Mahkemeleri yetkilidir.

LA NAPPE HOME KİŞİSEL VERİLERİN KORUNMASI (KVKK) AYDINLATMA METNİ

La Nappe Home olarak, müşterilerimizin kişisel verilerinin güvenliğine önem veriyoruz. 6698 sayılı KVKK kapsamında:

  • Veri Sorumlusu: Gonca Tunçer – la nappe home
  • Amaç: Siparişlerinizin yönetimi, fatura düzenlenmesi, kargo süreçlerinin takibi ve onay vermeniz halinde pazarlama faaliyetleri.
